1. Parties and what you are buying
This is a one-time remote scan authorization between the business named below and the person signing (together, “you”) and Diamond Bright LLC, which operates Diamond Bright CyberGuard at diamondguards.com (“the Company”). It covers every one-time remote scan in the checkout where you sign. It does not start a monthly protection plan. You install a temporary node on one computer you choose. The Company runs the purchased scan from that node, emails the report, and then revokes the node. This authorization takes effect only for the paid order tied to this signature, and only after payment is received. If payment is not completed, the Company will not run a scan under it.
2. Your authority
You represent that you are the owner of the business or a manager with actual authority to bind the business and to authorize security testing of the network where the node will be installed. If you do not have that authority, do not sign and do not install the node. A signature from someone without authority does not permit the scan.
3. Permission you are giving
You authorize the Company, its employees, and its contractors to receive check-ins from the node you install, to run only the purchased scan steps against systems reachable on that local network, and to collect the configuration and exposure observations needed for the report. You also authorize the Company to keep the report, the scan data, and this signed record for delivery, support, business records, and a later sale of the business. Testing permission ends when the report is delivered and the node is revoked, and it ends automatically 14 days after payment if the scan has not finished, unless you and the Company agree in writing to extend it. Permission to keep the report and this signed record continues after that.
4. Computer-crime laws
You give this permission for purposes of the Computer Fraud and Abuse Act, 18 U.S.C. § 1030, the Illinois computer-crime laws including 720 ILCS 5/17-51, and any similar federal, state, or local law. This signed form is your written authorization for the purchased scan. Accessing or testing a computer network without permission can be a crime.
5. What is not authorized
You do not authorize, and the Company will not perform, denial-of-service or stress testing, exploit attacks, password cracking, credential stuffing, installation of malware, changes to your systems, or social engineering of your staff. You do not authorize testing of any network, cloud account, ISP, landlord system, neighbor, guest Wi-Fi, employer, client, franchise, or other third party that you do not own or do not already have separate written permission to test. You do not authorize access after the node is revoked, other than keeping the report and this record.
6. Where you may install the node
Install the node only on a computer sitting on a network you are allowed to test. Do not install it at a client site, on an employer network, on a shared office network, or on guest Wi-Fi unless you already have written permission that covers this kind of testing. Describe that network below in enough detail that a later reader can tell what you meant (for example the business location and which office network). List systems that must not be scanned, such as medical devices, payment terminals, or production machines. If there are none, write None.
7. Disruption, findings, and what this is not
The Company will not try to disrupt your business. Scanning can still create log alerts, slow a device, or, rarely, interrupt a fragile system. You are responsible for your own backups. Findings are a point-in-time observation of what the scan could see. A missed issue is not a promise that the issue did not exist. A later breach is not, by itself, proof that the scan was done wrong. This purchase is not insurance, not a warranty that attacks will be stopped, not a 24/7 security operations center, and not legal, compliance, or insurance advice.
8. Stopping the scan
You may revoke this authorization before the scan starts by emailing [email protected] or calling (618) 936-8308 with the order number. The Company will stop as soon as reasonably practicable. The Company may also refuse or pause a scan if the installation looks unauthorized. Fees already paid are handled under the Legal Terms. Delivery of the installer counts as delivery of a digital product.
9. Data
The report and scan data are confidential business records. The Company uses them to deliver the scan, support the order, keep required records, and protect its own legal position. You control who inside your business receives the report. The Company does not sell the report. Payment-card data is handled by the payment processor, not stored in this authorization.
10. Liability and claims by other people
Except where the law does not allow a limit, including fraud or willful misconduct, the Company's total liability arising out of a scan covered by this authorization is limited to the amount you paid for that scan. Except where the law does not allow it, the Company is not liable for indirect or consequential damages, lost profits, business interruption, or lost data. You will defend and cover the Company, its owners, and its successors against claims by anyone else — including an employer, landlord, ISP, other tenant, cloud provider, or client — that arise because the node was installed, or the scan was aimed, at a system you were not allowed to test, or because a statement in this authorization was not true.
11. Electronic signature and your copy
You agree this electronic form is a writing. You can read it on the checkout page before you sign, and a copy is emailed to you so you can keep it. You may request another copy by emailing the Company. Typing your full legal name, so that it matches the signer name above, is your signature. You consent to electronic records under the federal Electronic Signatures in Global and National Commerce Act and the Illinois Uniform Electronic Transactions Act, 815 ILCS 333. The Company stores your name, title, business, email, phone, network description, exclusions, the boxes you checked, the typed signature, the date and time in UTC, the IP address and browser presented at checkout, this form version, and a hash of this text.
12. A sale of the Company
This authorization binds you and Diamond Bright LLC. The Company may assign it to a buyer of the Company or of the Diamond Bright CyberGuard business. The buyer may rely on this signed record for scans already authorized.
13. Law and the rest of the contract
Illinois law governs this authorization, without regard to conflict-of-law rules, except where a law that cannot be waived says otherwise. Courts located in Illinois are the venue, subject to that same limit. The Legal Terms published at https://diamondguards.com/legal apply to the website and the purchase. If those Terms and this authorization disagree about whether a scan was permitted, what it may include, or the liability limit for that scan, this authorization controls.
